Welcome to Kizz - Video Watermark Master ("Kizz," "App," "We," "Us," or "Our")—a gesture-driven video watermark and conversion tool designed to help users effortlessly build their brand by adding customized watermarks to videos. This User Agreement ("Agreement") governs your use of the Kizz App, including all features, content, and services provided through the App. By downloading, installing, or using Kizz, you ("User," "You," or "Your") agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree with any part of this Agreement, please do not use the Kizz App.
To use Kizz, you must be at least 13 years of age. By using the App, you represent and warrant that you are 13 years of age or older and have the legal capacity to enter into this Agreement. If you are using Kizz on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to this Agreement, and "You" shall refer to such entity.
Kizz is available for download on compatible mobile devices. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or business purposes, subject to compliance with this Agreement. Key terms of access and usage include:
Important: All intellectual property rights in Kizz (including the App’s design, code, logo, pink-themed interface, animations, and features) are owned by Kizz or its licensors. This Agreement does not transfer any ownership rights to you. You may only use Kizz’s intellectual property as expressly permitted by this Agreement.
With respect to videos and watermarks you create using Kizz: You retain all intellectual property rights in the videos you upload to the App and the watermarks you design (e.g., logos, signatures). Kizz does not claim ownership of your content, but we may use anonymized, non-identifiable data about your usage (e.g., frequency of watermark adjustments, preferred features) to improve the App, provided that such use complies with our Privacy Policy.
You are solely responsible for all content (including videos, watermarks, and any other materials) you upload, process, or share using Kizz. You represent and warrant that: (a) you have the right to use all content you upload to the App; (b) your content does not infringe the copyright, trademark, privacy, or other intellectual property or legal rights of any third party; (c) your content does not violate any applicable laws or regulations; and (d) your content will not harm or offend any person or entity. Kizz reserves the right (but is not obligated) to remove or disable access to any content that violates this Agreement or is otherwise objectionable, at our sole discretion.
We may update Kizz from time to time to improve functionality, add new features, fix bugs, or comply with legal requirements. These updates may be automatic or require your consent to download and install. We reserve the right to modify or discontinue any feature of Kizz at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuance of the App or its features.
Kizz is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that: (a) the App will be error-free, uninterrupted, or secure; (b) the App will meet your specific needs or expectations; (c) any errors in the App will be corrected; or (d) the App is compatible with all devices or operating systems. To the maximum extent permitted by applicable law, Kizz disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Kizz and its developers, licensors, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses, even if Kizz has been advised of the possibility of such damages. Our total liability to you for any claims arising out of this Agreement shall not exceed the amount you paid (if any) to download the App. Some jurisdictions do not allow the limitation of liability, so this section may not apply to you.
This Agreement shall remain in effect until terminated by either party. You may terminate this Agreement at any time by uninstalling Kizz from your device. We may terminate this Agreement and your access to Kizz at any time, without notice, if you violate any term of this Agreement. Upon termination, all licenses granted to you under this Agreement shall immediately cease, and you must uninstall Kizz from your device.
We may update this Agreement from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes, we will revise the "Last Updated" date at the top of this Agreement. We encourage you to review this Agreement periodically. Your continued use of Kizz after the effective date of any changes constitutes your acceptance of the revised Agreement.
This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction], without regard to its conflict of laws principles. Any disputes arising out of or in connection with this Agreement shall be resolved through good-faith negotiation first. If negotiation fails, the dispute may be submitted to the courts of [Insert Jurisdiction] for resolution.
